The OROTAL brand
The “Yerbador” trade mark is owned by OROTAL Commodities Trading SA, Avenue de Champel 29, 1206 Geneva, Switzerland (UID CHE-264.449.639). OROTAL is only the brand owner. It does not sell to you and it is not a party to your contract. The shop is run, and every order is sold, invoiced and shipped, by GREEN REPUBLIC sp. z o.o. from Poland.
2. Scope, countries we sell to, who may buy
These terms apply to all contracts of sale concluded through yerbador.com. We deliver to 29 countries. Poland is not one of them.
- EU (26): Austria, Belgium, Bulgaria, Croatia, Cyprus, Czechia, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden
- Outside the EU (3): United Kingdom, Switzerland, Norway
If you enter a delivery address in another country, we cannot accept the order.
Who may buy
- Consumers — you buy for purposes outside any trade or business. All rights in sections 9 to 13 are yours.
- Entrepreneurs with consumer rights — you are a sole trader, the purchase is connected with your business but is not of a professional character for you. Under Polish law you are treated like a consumer for withdrawal and conformity purposes.
- Business buyers — you buy in a professional capacity. The consumer rights in sections 9, 10 and 12 do not apply to you; the conformity rules in section 11 apply only as far as Polish law provides for business sales.
If you want an invoice with a VAT number, enter it during checkout. We cannot add it afterwards.
3. Products, food information and product safety
We sell foodstuffs and accessories for preparing mate:
- yerba mate (dried leaves of Ilex paraguariensis), teas and herbal blends, matcha, honey, food supplements
- accessories: matero/gourd, bombilla straw, tubes, cups and sets
The binding information about a product — its composition, ingredient list, allergens, net quantity, best-before date, country of origin, storage and preparation instructions and the name and address of the food business operator — is the information on the label of the product you receive. Product pages and photographs are for orientation only; recipes and packaging design can change.
Read the packaging before you consume anything. If you have an allergy, an intolerance, a medical condition, if you are pregnant or breastfeeding, or if you take medication, check the label first and consult your doctor or pharmacist if in doubt.
Food supplements are not medicinal products. They do not replace a varied and balanced diet or a healthy lifestyle. Do not exceed the recommended daily dose stated on the packaging. Keep out of reach of small children.
Store the goods as stated on the label and use them by the best-before date shown there.
4. Prices, currencies and VAT
- All prices shown in the shop are gross prices — VAT is included. Delivery charges are shown gross too.
- The figure you see at checkout is the figure we charge. There are no hidden fees, no handling fees and no payment surcharges.
- Base currency is EUR. The shop also prices in GBP, CZK, SEK, DKK, CHF and NOK. The currency follows the language version of the site and your delivery country.
- Inside the EU, VAT is charged at the rate of the country of delivery under the EU One-Stop-Shop (OSS) scheme. The gross price of the goods is the same in every country; only the VAT component inside it differs.
- The price binding for your order is the price displayed at the moment you place the order.
For deliveries to the United Kingdom, Switzerland and Norway the price does not include import charges. We ship DAP (Delivered at Place): import duties, import VAT and any customs clearance charges are payable by you to the carrier or to the customs authority. See section 14.
5. Placing an order and conclusion of the contract
- You add products to the cart and go to checkout.
- You enter your delivery and billing details, choose the delivery and the payment method, and enter a discount code if you have one.
- You see a summary with the goods, the total price including VAT and the delivery charge.
- You press the order button, which is marked with the obligation to pay, and you pay (section 6).
- We send you a confirmation of the order to the e-mail address you gave. That confirmation e-mail is the moment the contract is concluded.
Until then, the offer is ours to accept or refuse. If we cannot accept an order — for example the item is out of stock or the delivery country is not served — we tell you by e-mail and refund any payment in full.
The confirmation e-mail contains these terms and the information on the right of withdrawal. Keep it. If it does not arrive, check your spam folder and then write to [email protected].
Changing or cancelling an order
Before dispatch you can ask us by e-mail to change the address, change the items or cancel the order. Write to [email protected] and quote the order number. We dispatch within 24 hours on business days, so send the request as soon as possible. After dispatch, use the right of withdrawal in section 9 or the 90-day policy in section 10.
We do not take orders by telephone. Orders are placed only through the website.
6. Payment methods
You can pay with:
- PayPal — operated by PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg
- Debit and credit cards — processed by Stripe Payments Europe, Limited, 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland
The order is payable at the time you place it. We dispatch the goods after the payment reaches us. We never see or store your full card number; the payment data go to the payment provider.
If the payment fails or is not completed, we do not send an order confirmation, so no contract is concluded and nothing is dispatched. You can retry the payment or place the order again. If your bank or PayPal has blocked an amount for a payment that did not go through, it is released by the payment provider under its own rules.
7. Discount codes and promotions
- The welcome code SALE gives EUR 4.90 off orders with a minimum value of EUR 11.90.
- Enter the code in the cart or at checkout, before you pay. We cannot apply a code to an order that has already been placed.
- Discount codes cannot be combined with each other or with other promotions. One code per order.
- The discount is calculated on the value of the goods; it does not change the free-delivery thresholds in section 8.
8. Delivery, delivery charges, times and parcels
We ship with DPD from the European Union (Poland). All amounts below are gross, VAT included.
Delivery charges by zone
- Zone 1 — Germany, Austria, Belgium, Netherlands, Czechia: EUR 5.90; free delivery from EUR 69 of cart value.
- Zone 2 — France, Italy, Spain, Denmark, Slovakia, Slovenia, Hungary, Luxembourg: EUR 8.90; free delivery from EUR 89.
- Zone 3 — Sweden, Finland, Ireland, Portugal, Greece, Estonia, Latvia, Lithuania, Romania, Bulgaria, Croatia, Cyprus, Malta: EUR 11.90; free delivery from EUR 89.
- Zone 4 — United Kingdom: EUR 16.90 (GBP 14.90); free delivery from EUR 99.
- Zone 5 — Switzerland and Norway: EUR 14.90; free delivery from EUR 99.
In the other currencies the same amounts are shown converted and rounded — for example CZK 148.90 and DKK 68.90 for the EUR 5.90 and EUR 8.90 tariffs. The amount displayed at checkout is the amount charged.
Dispatch and delivery times
- Dispatch: within 24 hours on business days after payment.
- Delivery: 3-6 business days.
- For the United Kingdom, Switzerland and Norway add the time needed for customs clearance (section 14).
More detail on shipping is on our delivery page.
Checking the parcel on receipt
Look at the parcel when the courier hands it over. If the packaging is visibly damaged, opened or wet, note it on the courier’s delivery document or ask the courier to record the damage, and take photographs of the parcel and of the contents. Then write to [email protected]. This is not a condition of your rights — you can complain about damaged or missing goods anyway (section 11) — but photographs make it much faster.
Undelivered and refused parcels
Give a correct and complete address and a working telephone number and e-mail for the carrier’s notifications. If the courier cannot reach you, DPD leaves a notice and follows its own rules on a second attempt or pick-up point collection.
If a parcel comes back to us because it was refused, not collected, or the address was wrong, we contact you by e-mail and you choose: we send it again against payment of a new delivery charge, or we treat the matter as a withdrawal and refund you under section 9. For deliveries to the United Kingdom, Switzerland and Norway, a refusal to pay the import charges means the parcel is returned or destroyed by customs; see section 14.
9. Your right of withdrawal within 14 days
If you are a consumer, or an entrepreneur with consumer rights, you have 14 days to withdraw from the contract without giving any reason (Directive 2011/83/EU). The 14 days run from the day you or a person you nominated takes possession of the goods; if the order is delivered in several parcels, from the last one.
To withdraw, send us an unequivocal statement before the 14 days are over — by e-mail to [email protected], using the model withdrawal form or any other clear wording. Sending the statement in time is enough; the goods can follow.
Send the goods to: Yerbador, Green Republic sp. z o.o., ul. Przemysłowa 5, 05-230 Kobyłka, Poland.
- You pay the direct cost of returning the goods. We do not collect returns and we do not send return labels.
- We refund the full price you paid, plus the delivery cost you paid up to the amount of the cheapest standard delivery we offered for your order.
- We refund within 14 days of receiving your withdrawal statement. We may hold the refund until the goods reach us or until you send us proof that you have dispatched them.
- We refund using the same payment method you used. The refund costs you nothing.
- Some foodstuffs cannot be returned once the seal is broken — see the exclusions in section 10.
The full instructions, the deadlines and the model form are on our right of withdrawal page.
10. Our 90-day return policy for unopened goods
On top of the statutory 14 days, we give you a voluntary contractual right: 90 days from delivery to return unopened goods. This is our own promise. It does not replace or limit the statutory 14-day right in section 9 in any way, and it does not affect your rights under section 11.
Conditions of the 90-day policy:
- The product must be in its original, factory-sealed, undamaged packaging and fit for resale.
- Announce the return by e-mail to [email protected] within 90 days of delivery.
- Send the goods to: Yerbador, Green Republic sp. z o.o., ul. Przemysłowa 5, 05-230 Kobyłka, Poland. You pay the cost of return.
- We refund the price of the returned goods by the same payment method. Delivery charges are refunded only where section 9 requires it.
What cannot be returned
Article 16 of Directive 2011/83/EU excludes some goods from the right of withdrawal, and the same limits apply to our 90-day policy:
- goods sealed for health protection or hygiene reasons that were unsealed after delivery,
- goods liable to deteriorate or expire rapidly.
In plain words: yerba mate, tea, matcha, honey or supplements with a broken seal cannot be returned. Accessories — matero, bombilla, cups, tubes — can be returned normally. This exclusion has nothing to do with faulty goods: if a product is defective or not as described, use section 11.
11. Conformity of the goods and complaints
We are liable to you if the goods do not conform to the contract. Under Directive (EU) 2019/771 our liability covers any lack of conformity that exists at the time of delivery and becomes apparent within 2 years of delivery.
Goods conform when they match the description, quantity and quality we stated, are fit for the usual purpose and come with the packaging and instructions you can expect.
For foodstuffs, durability is limited by the best-before date on the packaging. We are liable for the goods being of the stated quality until that date, provided you stored them as the label says.
What you can demand
- repair or replacement, at your choice, free of charge; then
- a price reduction, or termination of the contract with a refund, if repair or replacement is impossible, disproportionate, not done within a reasonable time, or the defect reappears.
How to complain
- Write to [email protected]. Give the order number, describe the problem and attach photographs.
- We answer within 14 days.
- If we ask you to send the goods back, the address is: Yerbador, Green Republic sp. z o.o., ul. Przemysłowa 5, 05-230 Kobyłka, Poland. A complaint that we accept costs you nothing.
- Where the law of your own country gives you a longer or stronger guarantee period than two years, that law applies.
12. Out-of-court dispute resolution and courts
The European Commission’s ODR platform no longer exists. It stopped accepting new complaints on 20 March 2025 and ceased operating entirely on 20 July 2025, under Regulation (EU) 2024/3228, which repealed Regulation (EU) 524/2013. There is no longer any obligation to publish a link to it, and we do not publish one.
We are not obliged to use any particular alternative dispute resolution (ADR) body and we do not commit to one. You still have these routes:
- a competent ADR entity in your own country, if you want to try a settlement out of court;
- if you live in the EU, Norway or Iceland: free help and advice from the European Consumer Centres Network (ECC-Net), https://www.eccnet.eu/;
- in Poland: the provincial inspectorates of the Trade Inspection (Wojewódzki Inspektorat Inspekcji Handlowej).
Start by writing to [email protected] — most cases are settled there. Nothing in this section takes away your right to go to court.
13. Applicable law
Polish law applies to contracts concluded under these terms. This choice may not deprive you as a consumer of the protection of the mandatory provisions of the law of the country where you habitually live (Article 6 of Regulation (EC) No 593/2008, Rome I). Whichever rule protects you more, that rule applies.
As a consumer you may bring proceedings against us before the courts of your own country of residence. We may sue a consumer only before the courts of the consumer’s country of residence.
14. Special provisions for the United Kingdom, Switzerland and Norway
Parcels to these three countries leave the customs territory of the European Union and are imported into yours. We ship DAP (Delivered at Place).
- Import duties, import VAT and any customs clearance or handling charges of the carrier are payable by you, to the carrier or to the customs authority. They are not included in the price shown in the shop and we cannot tell you their amount in advance.
- We do not charge EU VAT on these orders. Import VAT, duty and any clearance fee are settled under the rules of your own country when the parcel is imported.
- Delivery takes longer than inside the EU: add the time your customs authority needs to clear the parcel to the 3-6 business days in section 8.
- Customs may open the parcel for inspection. A broken factory seal caused by a customs inspection is not your fault — tell us and we will deal with it under section 11.
- If you refuse to pay the import charges, the parcel is returned to us or destroyed by customs. If it returns to us, we refund the price of the goods less the actual cost of the return. Your right of withdrawal under section 9 is unaffected — but if you use it, send us the statement by e-mail instead of refusing the parcel, it is cheaper for you.
- Delivery charges: United Kingdom EUR 16.90 (GBP 14.90), free from EUR 99; Switzerland and Norway EUR 14.90, free from EUR 99.
- Some foodstuffs and supplements are subject to national import restrictions. Check the rules of your own country before ordering.
15. Personal data and cookies
The controller of your personal data is GREEN REPUBLIC sp. z o.o., ul. Marcina Kasprzaka 31/119, 01-234 Warszawa, Poland, [email protected]. We use your data to conclude and perform the sales contract, to invoice, to deliver, and to handle returns and complaints.
You have the right of access, rectification, erasure, restriction, data portability and objection, the right to withdraw consent at any time, and the right to complain to a supervisory authority — your own national authority or the Polish President of the Personal Data Protection Office. The full information required by Regulation (EU) 2016/679 (GDPR), including recipients, transfers outside the EEA and retention periods, is in our privacy policy.

16. Intellectual property
The content of yerbador.com — texts, product descriptions, photographs, graphics, the layout and the source code — is protected by copyright. It belongs to us or is used by us under licence. You may not copy, republish, scrape or use it commercially without our written consent.
The “Yerbador” trade mark belongs to OROTAL Commodities Trading SA (see section 1). Buying goods from us gives you no right to use the trade mark or any other sign shown in the shop.
You may of course use product photographs and descriptions to the extent needed to exercise your rights under sections 9 to 12 — for example when you send us a complaint.
17. Changes to these terms
We may change these terms — for example when the law, our delivery charges, our payment providers or our carriers change.
- A change never affects a contract already concluded. Your order is governed by the version of these terms that you received with your order confirmation.
- We publish each new version on this page with the date from which it applies.
- If you hold an account or a newsletter subscription, we tell you about material changes by e-mail before they take effect.
This version applies from 2026-09-15.
